Liberia News Update


In the legal fight for the release and repatriation of Dr. Malachi Z. K. York appointed Counsel General and Diplomat of the Republic of Liberia the Civil Courts of Monrovia, Liberia has just received ‘Action’ of ‘Bill of Information’ entered and filed on March 30th 2017 at 2:45 in the 6th Judicial Circuit, Civil Law Court for Sitting in its March Term, A.D. 2017, by Dr. Malachi Z. K. York through his counsel representation the African Center for Law and Human Rights (ACLHR) by and thru Frederick A. B. Jayweh, and Counsellor at Law, and Attorney Tommy N. Dougba.

This ‘Action’ taken in the courts has its genesis in the case of ‘Action’ of a Petition for Declaratory Judgment where Dr. Malachi Z. York by and through his Counsel Cllr. Francis Y. S. Garlawolo, Monrovia filed in June of 2004 an action of ‘Petition For Declaratory Judgment’, from where the sitting Judge Yussif D. Kaba in this cases final hearing ordered the Government of Liberia to,

‘To protect and defend (Diplomatic Protection) the person (Dr. Malachi Z. K. York) and the premises of Petitioner (404 Shady Dale Road, Eatonton, Ga. Tama-Re) a Diplomatic Personnel (Diplomatic Agent), to all intents and purposes (full Diplomatic Immunity) and in light of that, Respondent (the Government of Liberia) is further ordered to liaise (liason, to contact or connect maintained by communication) with the Government of the United State of America, to ensure the effective (Repatriation and deportation, and release Lands, Property) endorsement of this Judgment’

Also the Court further held that,

‘…that the Petitioner (Dr. Malachi Z. York) is entitled (granted a legal right), as a matter of law and right (International and Domestic Laws), to the protection (Diplomatic Protection) of the Respondent (the Government of Liberia)’

And the Court also hereby ordered the Government of Liberia,

‘….to repatriate (release and deport through Homeland Security, Immigration Court) Petitioner (Dr. Malachi Z. York) to the Republic of Liberia. Wherefore, it is the Judgment of this Court that the Petitioner (Dr. Malachi Z. York) and the same is hereby granted (legal right) and the Respondent is hereby ordered to give effect (makevalid; tocarryoutinpractice; topushtoitsresults) to this judgment.’

In review of these court proceedings and orders by the sitting judge Yusiff Kaba on July 21st, 2004, the government of Liberia had not a legal option when it chose to not carryout the orders of the courts of the Republic of Liberia in to its fullest effect. This judgment for repatriation and protection of Dr. Malachi Z. York’s person and full protection of Dr. Malachi Z. Yorks property as a ‘Diplomatic Personnel’ was ordered and the matter was suspended by the court and no further action was needed but for the Republic of Liberia to carry out the orders of the Court. Was the order carried out? No! Dr. Malachi Z. York is still incarcerated after 13 years of this court order! Has the property or person of Dr. Malachi Z. York been protected in accordance with the Courts Order? No! This is why H.E. Dr. Malachi Z. York has asked over and over again! Why is he not HOME YET! If you are a supporter of H.E. Dr. Malachi Z.
